Acceptable Use Policy
This Acceptable Use Policy ("AUP") is part of the AcqoraGX Terms of Service. It sets minimum rules for using the AcqoraGX CRM and dialer to call, text, email and record people. It doesn't list every law that applies to you. You are responsible for knowing and following the laws and carrier rules that apply to your business, and for getting your own legal advice.
1. You are the caller and the sender
AcqoraGX provides software. You decide whom to contact, when, how, with what message, and on what legal basis, and you are legally responsible for every call, text, voicemail, email and recording made through your Workspace, including through your own carrier and AI provider accounts. Our compliance tools (calling-hour limits, quiet hours, do-not-call flags and scrubbing, opt-out handling, recording announcements) help but don't make your outreach lawful.
2. Consent for calls and texts (TCPA and state laws)
- Get the consent the law requires before you call or text. Under the federal Telephone Consumer Protection Act (TCPA) and FCC rules, marketing or solicitation calls and texts to wireless numbers made with an automatic telephone dialing system, or using an artificial or prerecorded voice, generally require the recipient's prior express written consent. Several states have their own "mini-TCPA" laws, some stricter than federal law (for example Florida's).
- Treat multi-line and power dialing, automated texts and voicemail drops as features that may require consent. Don't assume they fall outside the law.
- AI-generated or cloned voices are "artificial" voices under the TCPA. Don't use them in calls without the consent required for prerecorded calls.
- A phone number from a purchased list, a lead vendor, a skip trace, a property record or a website is not consent.
- Honor revocations of consent made by any reasonable means (for example "stop", "don't call me", "remove me") promptly and within the time the law requires.
3. Do-not-call
- Unless an exemption clearly applies, scrub telemarketing calls and texts against the National Do Not Call Registry (with a list no more than 31 days old) and applicable state do-not-call lists.
- Keep and honor your own internal do-not-call list. Record do-not-call requests in AcqoraGX as soon as they're made; we block calls and texts to numbers marked do-not-call or opted out.
- Only rely on an exemption (such as an established business relationship) if it truly applies to that person. The Workspace's DNC exemption setting records your position; it doesn't create an exemption.
- Our DNC scrubbing uses third-party data and may be incomplete or delayed. You remain responsible for the result.
4. Calling hours, quiet hours and frequency
- Federal rules prohibit telephone solicitations before 8 a.m. or after 9 p.m. in the called person's local time. Some states are stricter: for example Washington and Florida limit solicitation calls to 8 a.m.–8 p.m., and Florida limits repeat calls on the same subject within 24 hours.
- Set your Workspace calling hours and SMS quiet hours to the strictest rule that applies to the people you contact (defaults are 9 a.m.–8 p.m. for calls and no texts 9 p.m.–8 a.m.). Contacts' time zones are estimated from their area code or address, which may be wrong.
- Don't call or text so often that it is harassing or abusive.
- Identify yourself and your business at the start of every call and in texts, give a call-back number, and never block or falsify caller ID.
5. Call recording consent
Some states require the consent of everyone on a call before it is recorded, including Washington and Florida, as well as (among others) California, Illinois, Maryland, Massachusetts, Montana, New Hampshire and Pennsylvania. This list isn't complete and laws change. When parties are in different states, follow the strictest applicable law. Keep the recording announcement on (it plays before the agent is connected) unless your counsel confirms you don't need it, and don't record people who object. Don't use recordings for any purpose your notice didn't cover.
6. Business texting and A2P 10DLC
- Texts from local (10-digit) business numbers to U.S. phones must be sent under a registered A2P 10DLC brand and campaign, which you complete in your carrier account (for example Twilio Messaging → Regulatory Compliance). Unregistered or mis-described traffic can be blocked or filtered, and carrier fees apply.
- Describe your campaign's use case, sample messages and opt-in method accurately, and send only the kind of messages you registered.
- Every first message must identify your business, and messages must honor STOP (and similar opt-out words) and respond to HELP. AcqoraGX processes STOP/START replies on connected numbers and blocks opted-out numbers.
- Don't send content that carriers prohibit or restrict (for example sex, hate, alcohol, firearms, tobacco or cannabis content), and don't use shared or public URL shorteners, number rotation ("snowshoeing") or other techniques to evade filtering.
7. Email
Emails you send through the Service must comply with CAN-SPAM and similar laws: accurate headers and subject lines, your physical address, and a working unsubscribe that you honor. Don't email purchased lists of people who haven't agreed to hear from you where the law requires consent.
8. Consent records and lead sources
- Keep records showing when, where and how each person consented (or why an exemption applies) for at least as long as claims can be brought, and produce them to us promptly if we ask in connection with a complaint, carrier inquiry or legal claim.
- You are responsible for the lawful sourcing of every lead, list and number you upload or obtain through the Service, and for your vendors' compliance.
- Skip-trace and data-append results may be used only for lawful purposes permitted by their providers. They may not be used to determine eligibility for credit, insurance, employment or housing, or for any purpose governed by the Fair Credit Reporting Act.
9. Prohibited uses
You may not use the Service to:
- make robocalls, send spam, or call or text anyone without the consent or exemption the law requires;
- spoof or falsify caller ID or sender information, or impersonate a person, company or government agency;
- defraud or mislead anyone, including foreclosure-rescue or equity-stripping schemes, false claims of being a buyer, lender or agency, or hiding material terms of a real-estate transaction or an assignment of contract;
- harass, threaten or abuse anyone, or call emergency lines, hospitals or numbers where calls are prohibited;
- discriminate unlawfully, including in violation of the Fair Housing Act;
- collect or process sensitive information (such as health, financial-account or government ID numbers) about your contacts unless the Service is designed for it and the law allows it;
- send or store malware, or content that is illegal, infringing or sexually explicit;
- interfere with or overload the Service or carrier networks, probe or test its security without permission, scrape it, or get around usage limits or identity-verification requirements;
- resell or share access to the Service, numbers or credits without our written agreement; or
- use AI features to create deceptive content, to impersonate a real person's voice or identity, or in ways that violate your AI provider's usage policies.
10. Real-estate licensing
Some states regulate wholesaling, assignment of purchase contracts and marketing properties you don't own. You are responsible for holding any licenses and making any disclosures required where you operate.
11. Enforcement and cooperation
We may investigate suspected violations, and we may suspend calling, texting or the whole Workspace, remove content, release numbers we provide, or terminate your account, with or without notice, if we believe this AUP or the law has been violated or a carrier or regulator requires it. We cooperate with carriers, the Industry Traceback Group and law enforcement, which may include sharing call records and account information as permitted by law. You must cooperate with our investigations and respond to traceback requests about your traffic.
12. Reporting abuse
To report unwanted calls or texts from a AcqoraGX customer, or any other violation of this AUP, email [LEGAL_CONTACT_EMAIL not set] with the number that contacted you and the date and time. We'll investigate and, where appropriate, forward the report to the customer.
